北京市關(guān)于進(jìn)一步加強(qiáng)穩(wěn)外資工作的若干措施

??為貫徹《中華人民共和國(guó)外商投資法》及其配套法規(guī)，落實(shí)黨中央、國(guó)務(wù)院關(guān)于加強(qiáng)利用外資工作的決策部署，進(jìn)一步推進(jìn)本市更高水平對(duì)外開放，提高投資便利化水平，加強(qiáng)外商投資合法權(quán)益保護(hù)，積極促進(jìn)外商投資，以開放促改革促發(fā)展，推動(dòng)形成本市全方位高水平開放新格局?，F(xiàn)提出本市進(jìn)一步促進(jìn)外商投資的若干措施如下：

??一、進(jìn)一步擴(kuò)大對(duì)外開放
　　1.落實(shí)國(guó)家開放政策。深入實(shí)施外商投資準(zhǔn)入前國(guó)民待遇加負(fù)面清單管理制度，落實(shí)好全國(guó)版和自貿(mào)試驗(yàn)區(qū)版外商投資準(zhǔn)入特別管理措施，加快推進(jìn)金融、汽車等領(lǐng)域開放政策在京落地。（責(zé)任單位：市商務(wù)局，市發(fā)展改革委，市金融監(jiān)管局，市經(jīng)濟(jì)和信息化局及相關(guān)部門和各區(qū)政府）
　　2.深化重點(diǎn)領(lǐng)域開放。在特定區(qū)域（自貿(mào)試驗(yàn)區(qū)）取消應(yīng)用商店的信息服務(wù)業(yè)務(wù)外資股比限制；爭(zhēng)取國(guó)家增值電信業(yè)務(wù)進(jìn)一步開放試點(diǎn)，探索在自貿(mào)試驗(yàn)區(qū)特定區(qū)域率先開放互聯(lián)網(wǎng)數(shù)據(jù)中心（IDC）等增值電信業(yè)務(wù)；積極爭(zhēng)取數(shù)字經(jīng)濟(jì)、數(shù)字貿(mào)易領(lǐng)域開放政策在京先行先試。推進(jìn)研究型醫(yī)院建設(shè)，鼓勵(lì)符合條件的外資企業(yè)參與“互聯(lián)網(wǎng)+醫(yī)療健康”創(chuàng)新發(fā)展；積極爭(zhēng)取外資獨(dú)資醫(yī)療機(jī)構(gòu)開放政策在京落地。吸引一批國(guó)際頂（更多政策，請(qǐng)查閱中房網(wǎng) www.corporatebenefitsplanning.com）尖的會(huì)計(jì)、法律、建筑、管理咨詢、廣告等知名企業(yè)在京落地。推進(jìn)職業(yè)教育國(guó)際合作示范項(xiàng)目，允許經(jīng)營(yíng)性職業(yè)技能培訓(xùn)機(jī)構(gòu)落戶。對(duì)外資高端制造類大型龍頭企業(yè)，符合國(guó)家鼓勵(lì)外商投資產(chǎn)業(yè)目錄的，可以納入本市重大外資項(xiàng)目專班，給予協(xié)調(diào)推進(jìn)。積極落實(shí)國(guó)家發(fā)展改革委權(quán)限下放政策，對(duì)總投資3億美元以下鼓勵(lì)類外商投資項(xiàng)目進(jìn)一步優(yōu)化服務(wù)。（責(zé)任單位：市衛(wèi)生健康委，市經(jīng)濟(jì)和信息化局，市投資促進(jìn)服務(wù)中心，市教委，市人力資源社會(huì)保障局，市發(fā)展改革委及相關(guān)部門和各區(qū)政府）
　　3.探索構(gòu)建現(xiàn)代化開放體系。推進(jìn)中國(guó)(北京)自由貿(mào)易試驗(yàn)區(qū)和國(guó)家服務(wù)業(yè)擴(kuò)大開放綜合示范區(qū)(以下簡(jiǎn)稱“兩區(qū)”)建設(shè)，發(fā)揮擴(kuò)大開放試驗(yàn)田作用，對(duì)標(biāo)最高標(biāo)準(zhǔn)、最好水平，選擇符合國(guó)家戰(zhàn)略、國(guó)際市場(chǎng)需求大、對(duì)外開放度要求高的重點(diǎn)領(lǐng)域，開展差異化探索。在全面落實(shí)國(guó)務(wù)院批復(fù)的“兩區(qū)”任務(wù)和本市“9大領(lǐng)域+17個(gè)區(qū)域+4大要素”方案的基礎(chǔ)上，以重點(diǎn)領(lǐng)域全產(chǎn)業(yè)鏈開放和全環(huán)節(jié)改革為突破口，打造規(guī)則制度型開放水平更高、產(chǎn)業(yè)國(guó)際合作競(jìng)爭(zhēng)力更強(qiáng)、區(qū)域開放布局更加均衡的首都開放體系。（責(zé)任單位：市“兩區(qū)”辦，市各相關(guān)部門及各區(qū)政府）

??二、聚集全球高端優(yōu)質(zhì)資源
　　4.打造更高能級(jí)總部經(jīng)濟(jì)。貫徹落實(shí)《北京市促進(jìn)總部企業(yè)高質(zhì)量發(fā)展的相關(guān)規(guī)定》及相關(guān)配套措施。鼓勵(lì)外國(guó)投資者在本市設(shè)立跨國(guó)公司地區(qū)總部和各類功能性機(jī)構(gòu)，支持其集聚業(yè)務(wù)、拓展功能，升級(jí)為亞太總部、全球總部。符合條件的跨國(guó)公司地區(qū)總部可以享受資金獎(jiǎng)勵(lì)及重點(diǎn)人員出入境、貨物通關(guān)等便利化措施。創(chuàng)新舉措，持續(xù)做好跨國(guó)公司地區(qū)總部和各類功能性機(jī)構(gòu)的引進(jìn)和服務(wù)工作。（責(zé)任單位：市商務(wù)局及相關(guān)部門，各區(qū)政府）
　　5.鼓勵(lì)外資設(shè)立研發(fā)中心。研究制定我市設(shè)立外資研發(fā)中心的相關(guān)鼓勵(lì)政策措施，增強(qiáng)全球資源配置和科技創(chuàng)新策源功能。鼓勵(lì)外國(guó)投資者在本市設(shè)立研發(fā)創(chuàng)新中心、外資研發(fā)總部、開放式創(chuàng)新平臺(tái)等，支持外資研發(fā)機(jī)構(gòu)參與本市研發(fā)公共服務(wù)平臺(tái)建設(shè)和政府科技計(jì)劃項(xiàng)目。符合條件的外資研發(fā)中心與內(nèi)資研發(fā)機(jī)構(gòu)同等待遇，在研發(fā)成果產(chǎn)業(yè)化、國(guó)際國(guó)內(nèi)專利申請(qǐng)、研發(fā)用品進(jìn)口、出入境等方面享受一攬子便利化措施。落實(shí)國(guó)家關(guān)于科技創(chuàng)新減免稅政策，對(duì)符合條件的外商投資企業(yè)實(shí)施研究開發(fā)費(fèi)用稅前加計(jì)扣除、進(jìn)口設(shè)備減免稅等優(yōu)惠政策。（責(zé)任單位：市科委、中關(guān)村管委會(huì)，市商務(wù)局，市財(cái)政局，北京市稅務(wù)局及相關(guān)部門）
　　6.提升開放平臺(tái)示范引領(lǐng)效應(yīng)。開展“兩區(qū)”立法，深入開展投資貿(mào)易自由化便利化改革創(chuàng)新，增強(qiáng)自貿(mào)試驗(yàn)區(qū)外資聚集效應(yīng)。用好國(guó)家（更多政策，請(qǐng)查閱中房網(wǎng) www.corporatebenefitsplanning.com）級(jí)經(jīng)濟(jì)技術(shù)開發(fā)區(qū)新一輪支持政策，優(yōu)化生產(chǎn)要素配置，聚焦國(guó)際先進(jìn)企業(yè)，鼓勵(lì)引導(dǎo)新一代信息技術(shù)、新能源汽車、生物技術(shù)和大健康、機(jī)器人和智能制造等主導(dǎo)產(chǎn)業(yè)在北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)集聚發(fā)展。發(fā)揮國(guó)際國(guó)內(nèi)協(xié)同創(chuàng)新優(yōu)勢(shì)，搭建市場(chǎng)化、專業(yè)化產(chǎn)業(yè)服務(wù)平臺(tái)，打造國(guó)際化協(xié)同創(chuàng)新網(wǎng)絡(luò)，推動(dòng)“三城一區(qū)”在集成電路、新材料、醫(yī)藥健康等重點(diǎn)領(lǐng)域融合創(chuàng)新，促進(jìn)創(chuàng)新鏈、產(chǎn)業(yè)鏈、供應(yīng)鏈“三鏈聯(lián)動(dòng)”，引導(dǎo)高精尖產(chǎn)業(yè)集群發(fā)展。發(fā)揮綜合保稅區(qū)政策優(yōu)勢(shì)，積極拓展保稅研發(fā)、租賃、維修等功能，重點(diǎn)發(fā)展先進(jìn)制造、供應(yīng)鏈管理、保稅服務(wù)等業(yè)務(wù)。推進(jìn)中日、中德國(guó)際合作產(chǎn)業(yè)園建設(shè)，對(duì)接區(qū)域全面經(jīng)濟(jì)伙伴關(guān)系協(xié)定等經(jīng)貿(mào)協(xié)定，創(chuàng)新國(guó)際合作機(jī)制，支持園區(qū)建立健全對(duì)外招商引資、引智渠道，探索園區(qū)國(guó)際化建設(shè)模式，打造國(guó)際化環(huán)境。（責(zé)任單位：市“兩區(qū)”辦，市經(jīng)濟(jì)和信息化局，市科委、中關(guān)村管委會(huì)，北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)管委會(huì)及相關(guān)部門，有關(guān)區(qū)政府）

??三、優(yōu)化外商投資企業(yè)發(fā)展環(huán)境
　　7.推進(jìn)貿(mào)易投融資便利化。實(shí)施跨國(guó)公司本外幣一體化資金池業(yè)務(wù)試點(diǎn)，對(duì)跨境資金流動(dòng)實(shí)施雙向宏觀審慎管理。穩(wěn)步推進(jìn)貿(mào)易外匯收支便利化試點(diǎn)，進(jìn)一步擴(kuò)大便利化試點(diǎn)銀行和試點(diǎn)企業(yè)范圍。在全市優(yōu)化升級(jí)資本項(xiàng)目收入支付便利化政策，推動(dòng)銀行采取單證合并、線上辦理等方式。在中關(guān)村海淀園區(qū)升級(jí)外債便利化政策，注冊(cè)在中關(guān)村海淀園區(qū)且符合規(guī)定條件的企業(yè)實(shí)施外債便利化試點(diǎn)政策，試點(diǎn)額度由500萬美元進(jìn)一步提高到1000萬美元。支持符合條件的中關(guān)村國(guó)家自主創(chuàng)新示范區(qū)一區(qū)十六園內(nèi)企業(yè)可將外債資金用于符合規(guī)定的股權(quán)投資（房地產(chǎn)投資除外）。放寬企業(yè)外債簽約幣種、提款幣種和償還幣種須保持一致的要求，但提款幣種和償還幣種須保持一致。將外債注銷登記、內(nèi)保外貸注銷登記、境外放款注銷登記下放銀行辦理。支持北京地區(qū)銀行不斷提升跨境金融服務(wù)能力，為優(yōu)質(zhì)誠信企業(yè)貨物貿(mào)易、服務(wù)貿(mào)易跨境人民幣結(jié)算以及資本項(xiàng)目人民幣收入境內(nèi)依法合規(guī)使用提供便利化服務(wù)。優(yōu)化外匯收支單證審核流程，按照展業(yè)原則辦理貨物貿(mào)易、服務(wù)貿(mào)易項(xiàng)下購付匯、收結(jié)匯及劃轉(zhuǎn)等手續(xù)，便利真實(shí)合規(guī)跨境貿(mào)易外匯收支業(yè)務(wù)。強(qiáng)化金融支持穩(wěn)外資作用，加強(qiáng)銀行等金融機(jī)構(gòu)與外資企業(yè)的對(duì)接，對(duì)重點(diǎn)外資企業(yè)和外資重點(diǎn)項(xiàng)目建立投貸融資服務(wù)機(jī)制。（責(zé)任單位：人民銀行營(yíng)業(yè)管理部，國(guó)家外匯管理局北京管理部，市金融監(jiān)管局）
　　8.進(jìn)一步提高通關(guān)便利化。指導(dǎo)支持更多外資企業(yè)申請(qǐng)AEO認(rèn)證，享受更多便利化通關(guān)政策。打造公開、透明的口岸通關(guān)環(huán)境，線上線下同步公開空港口岸經(jīng)營(yíng)服務(wù)收費(fèi)清單，定期更新，在線查詢，做到清單之外無收費(fèi)，降低通關(guān)成本。加快“單一窗口”功能由口岸通關(guān)執(zhí)法向物流、服務(wù)貿(mào)易等全鏈條擴(kuò)展。推進(jìn)“提前申報(bào)”“兩步申報(bào)”等措施，進(jìn)一步壓縮通關(guān)時(shí)間，提高通關(guān)效率。（責(zé)任單位：北京海關(guān)，市商務(wù)局等相關(guān)部門）
　　9.用好稅收優(yōu)惠政策。宣傳落實(shí)境外投資者以分配利潤(rùn)直接投資暫不征收預(yù)提所得稅等優(yōu)惠政策。落實(shí)好中關(guān)村國(guó)家自主創(chuàng)新示范區(qū)特定區(qū)域（包括：朝陽園、海淀園、豐臺(tái)園、順義園、大興—亦莊園、昌平園）技術(shù)轉(zhuǎn)讓企業(yè)所得稅試點(diǎn)優(yōu)惠政策，符合條件的技術(shù)轉(zhuǎn)讓所得，在一個(gè)納稅年度內(nèi)不超過2000萬元的部分，免征企業(yè)所得稅；超過2000萬元部分，減半征收企業(yè)所得稅。對(duì)在京從事集成電路、人工智能、生物醫(yī)藥、關(guān)鍵材料等領(lǐng)域生產(chǎn)研發(fā)類規(guī)模以上企業(yè)認(rèn)定高新技術(shù)企業(yè)時(shí)，滿足從業(yè)一年以上且在中國(guó)境內(nèi)發(fā)生的研究開發(fā)費(fèi)用總額占全部研究開發(fā)費(fèi)用總額的比例不低于50%條件的，實(shí)行“報(bào)備即批準(zhǔn)”，認(rèn)定為高新技術(shù)企業(yè)即可按規(guī)定享受所得稅優(yōu)惠等相關(guān)政策。（責(zé)任單位：市財(cái)政局，北京市稅務(wù)局，市人才局，市商務(wù)局，北京海關(guān)等相關(guān)部門，各區(qū)政府）
　　10.規(guī)范企業(yè)有序遷移。尊重企業(yè)意愿，支持企業(yè)按照經(jīng)營(yíng)發(fā)展意愿，在本市范圍自主有序流動(dòng)布局，不得為企業(yè)跨區(qū)遷移設(shè)置障礙；企業(yè)申請(qǐng)辦理變更登記時(shí)，市場(chǎng)監(jiān)管、稅務(wù)等部門應(yīng)依法依規(guī)及時(shí)予以辦理。由市財(cái)政局（市財(cái)源辦）牽頭組織協(xié)調(diào)相關(guān)部門落實(shí)企業(yè)遷移市區(qū)聯(lián)動(dòng)服務(wù)工作機(jī)制，實(shí)現(xiàn)跨區(qū)財(cái)稅利益共享，更好地平衡遷入?yún)^(qū)和遷出區(qū)的利益。（責(zé)任單位：市財(cái)政局，北京市稅務(wù)局，市市場(chǎng)監(jiān)管局，市科委、中關(guān)村管委會(huì)，北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)管委會(huì)，各區(qū)政府）

??四、優(yōu)化外商生活服務(wù)
　　11.優(yōu)化教育服務(wù)。加大優(yōu)質(zhì)教育資源供給，完善國(guó)際學(xué)校布局，在人才引進(jìn)密集區(qū)域合理布局一批國(guó)際學(xué)校，為擴(kuò)大國(guó)際教育供給、服務(wù)國(guó)際人才子女教育需求提供保障。下放外籍人員子女學(xué)校審批和管理權(quán)限，減少辦事層級(jí)、簡(jiǎn)化辦事流程；放寬舉辦者限制，允許中國(guó)社會(huì)組織和個(gè)人舉辦外籍人員子女學(xué)校。支持中小學(xué)按國(guó)家和我市有關(guān)規(guī)定接收外籍人員子女入學(xué)。（責(zé)任單位：市教委，市人才局等相關(guān)部門，各區(qū)政府，北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)管委會(huì)）
　　12.增強(qiáng)醫(yī)療保障。規(guī)劃建設(shè)若干國(guó)際醫(yī)院。支持具備條件的醫(yī)療機(jī)構(gòu)提供國(guó)際醫(yī)療服務(wù)。探索國(guó)際醫(yī)療聯(lián)合體，完善機(jī)構(gòu)合作、分級(jí)診療等功能集成的國(guó)際化醫(yī)療服務(wù)新模式。加強(qiáng)外商企業(yè)及員工駐地的社區(qū)衛(wèi)生服務(wù)機(jī)構(gòu)建設(shè)，做好社區(qū)醫(yī)療服務(wù)。探索構(gòu)建國(guó)際化院前急救服務(wù)體系，持續(xù)提升醫(yī)療急救整體水平。增強(qiáng)涉外服務(wù)能力，支持試點(diǎn)醫(yī)院聘用符合外國(guó)人來華工作條件的外籍醫(yī)助、外籍導(dǎo)醫(yī)，加強(qiáng)醫(yī)護(hù)人員外語培訓(xùn)，綜合提升外語服務(wù)能力。外籍就業(yè)人員、外企員工均可參加本市基本醫(yī)療保險(xiǎn)，享受相關(guān)醫(yī)療保障待遇。推進(jìn)商業(yè)健康險(xiǎn)和基本醫(yī)療保險(xiǎn)的有效銜接；推動(dòng)商業(yè)保險(xiǎn)與醫(yī)療機(jī)構(gòu)合作對(duì)接，開展實(shí)時(shí)結(jié)算。（責(zé)任單位：市衛(wèi)生健康委，市醫(yī)保局，北京銀保監(jiān)局，市人力資源社會(huì)保障局等相關(guān)部門，各區(qū)政府，北京經(jīng)濟(jì)技術(shù)開發(fā)區(qū)管委會(huì)）
　　13.提升生活辦事便利化水平。推進(jìn)實(shí)現(xiàn)外籍人員線上辦理臨時(shí)住宿登記。積極推進(jìn)在華永久居留身份證在鐵路、民政、社保、銀行、不動(dòng)產(chǎn)登記、醫(yī)院、公園等系統(tǒng)實(shí)現(xiàn)全面適用。對(duì)已獲得在華永久居留資格或持有工作類居留許可的外籍高層次人才、創(chuàng)新創(chuàng)業(yè)人才和港澳高層次人才，可以為其聘雇的外籍家政服務(wù)人員來華申請(qǐng)相應(yīng)期限的私人事務(wù)類居留許可（加注“家政服務(wù)”）。實(shí)施在華外籍人才個(gè)人外匯業(yè)務(wù)便利化試點(diǎn)，滿足在華外籍人才真實(shí)合規(guī)的個(gè)人經(jīng)常項(xiàng)目用匯需求。簡(jiǎn)化在華工作境外個(gè)人薪酬購匯手續(xù)，在勞動(dòng)合同有效期內(nèi)到同一銀行再次辦理合法薪酬收入購匯的，試點(diǎn)銀行可根據(jù)首次辦理情況，免于審核重復(fù)性材料。加快推動(dòng)外籍員工參與境內(nèi)上市公司股權(quán)激勵(lì)登記、變更及注銷登記下放銀行辦理試點(diǎn)落地實(shí)施。外資企業(yè)在企業(yè)納稅地所在區(qū)對(duì)接保障性租賃住房時(shí)與內(nèi)資企業(yè)享受同等待遇。（責(zé)任單位：市公安局，市人力資源社會(huì)保障局，國(guó)家外匯管理局北京管理部，市人才局，市住房城鄉(xiāng)建設(shè)委等相關(guān)部門）
　　14.豐富國(guó)際化消費(fèi)供給。打造2至3個(gè)千億規(guī)模世界（更多政策，請(qǐng)查閱中房網(wǎng) www.corporatebenefitsplanning.com）級(jí)商圈，打造一批具有全球影響力的標(biāo)志性商圈。吸引國(guó)內(nèi)外一線品牌機(jī)構(gòu)在京發(fā)展，大力引進(jìn)國(guó)內(nèi)外知名品牌首店、旗艦店、體驗(yàn)店、定制中心，構(gòu)建國(guó)際化優(yōu)質(zhì)商品供給體系。吸引更多國(guó)際化餐飲品牌落地北京，為在京外國(guó)人提供多樣化、品質(zhì)化餐飲消費(fèi)場(chǎng)所。釋放文旅消費(fèi)潛力，挖掘文化資源優(yōu)勢(shì)，打造北京文創(chuàng)品牌，提升“北京禮物”吸引力和影響力。搭建全球新品首發(fā)首秀活動(dòng)平臺(tái)，打造時(shí)尚品牌活動(dòng)風(fēng)向標(biāo)，全面提升北京國(guó)際電影節(jié)、北京國(guó)際音樂節(jié)、“電競(jìng)北京”的國(guó)際影響力，積極引進(jìn)和培育國(guó)際體育賽事，吸引國(guó)際知名體育機(jī)構(gòu)落戶北京。優(yōu)化交通、旅游、支付等配套服務(wù)，進(jìn)一步提升商業(yè)服務(wù)業(yè)領(lǐng)域公共場(chǎng)所外語標(biāo)識(shí)規(guī)范化水平，擦亮有溫度的“北京服務(wù)”品牌。對(duì)標(biāo)國(guó)際建立統(tǒng)一、便民、高效的消費(fèi)申訴和聯(lián)動(dòng)處理機(jī)制，優(yōu)化消費(fèi)維權(quán)機(jī)制。（責(zé)任單位：北京培育建設(shè)國(guó)際消費(fèi)中心城市領(lǐng)導(dǎo)小組相關(guān)成員單位）

??五、推動(dòng)引資與引智引才相結(jié)合
　　15.優(yōu)化人才服務(wù)體系。推進(jìn)“落地即辦、未落先辦、全程代辦”人才服務(wù)體系，構(gòu)建外籍人才工作服務(wù)網(wǎng)絡(luò)。符合條件的外資企業(yè)中國(guó)籍員工可以申辦亞太經(jīng)合組織商務(wù)旅行卡。改革創(chuàng)新外籍人才工作證件辦理模式，逐步實(shí)現(xiàn)簽證證件業(yè)務(wù)全市通辦和“兩證合一”聯(lián)辦模式。優(yōu)化外籍人才來京就業(yè)審批辦事流程，逐步下放外國(guó)人來華工作許可預(yù)審環(huán)節(jié)，進(jìn)一步深化簡(jiǎn)政放權(quán)提高服務(wù)效率。為符合條件的外籍人才辦理永久居留證件。深入開發(fā)“易北京”APP應(yīng)用，打造外籍人才“一站式”線上服務(wù)平臺(tái)。（責(zé)任單位：市人才局，市人力資源社會(huì)保障局，北京海外學(xué)人中心，市政府外辦，市公安局，北京海關(guān)）

Several Measures of Beijing Municipality to Further Strength the Work of Stabilizing Foreign Investment

??In order to implement the Foreign Investment Law of the People's Republic of China and related laws and regulations, carry out the decisions and arrangement of the Communist Party of China Central Committee and the State Council on strengthening the use of foreign capital, further promote the capital city's higher level of opening-up to the outside world, improve the level of investment facilitation, strengthen the protection of the legitimate rights and interests of foreign investors, promote foreign investment, speed up reform and development through opening-up, and promote the formation of a new pattern of all-round high-level opening-up in Beijing. Several measures to further promote foreign investment in this city are proposed as follows:

I. Further expand opening-up
1. Implement the national opening-up policy. We shall thoroughly maintain a system of pre-entry national treatment plus a negative list management for foreign investment, implement the special management measures for foreign investment access in the national version and the pilot free trade zone version, and accelerate the implementation of the opening-up policy in the finance and automobiles in Beijing. 2. Deepen the opening-up of key fields. We shall cancel the restrictions on the foreign shareholding ratio of information service businesses in application stores in certain areas (pilot free trade zones); strive to further open pilot programs for national value-added telecommunications services, and explore to be the first to open Internet Data Centers (IDCs) and other value-added telecommunications services in specific areas of pilot free trade zones; strive for the first trial of opening policies in the digital economy and trade in Beijing. We shall promote the construction of research hospitals, encourage qualified foreign-funded enterprises to participate in the innovative development of "Internet + medical health"; actively strive for the implementation of the opening-up policies of foreign wholly owned medical institutions in Beijing. We shall attract a number of top international accounting, legal, construction, management consulting, advertising enterprises to settle in Beijing, promote international cooperation projects for vocational education, and allow vocational training institutions to settle in Beijing. Large-scale foreign-funded manufacturing enterprises, which meet the national directory of foreign-funded industries encouraged by the state, can be included in the city's special projects for coordinated advancement. We shall actively implement the decentralization policy of the National Development and Reform Commission, and further optimize services for foreign investment projects with a total investment of less than $300 million. 3. Explore the construction of a modern and open system. We shall promote the construction of the China (Beijing) Pilot Free Trade Zone and the Comprehensive Demonstration Zone for the Expansion and Opening of the National Service Industry (hereinafter referred to as the "Two Zones"), play the role of the expansion of the opening test field, benchmark the highest standards and best practices, and select key areas that are in line with the national strategy, large international market demand, and high degree of openness, and carry out tailored explorations. Based on the full implementation of the "Two Zones" tasks approved by the State Council and the city's "9 key areas + 17 districts + 4 key elements" plan, with the opening-up of the entire industry chain in key areas and the reform of all links as a breakthrough, we shall create a capital opening system with a higher level of rule-based and institutional opening, stronger industrial international cooperation competitiveness, and a more balanced regional opening-up layout. II. Gather high-end and high-quality resources across the global
4. Create a higher-level headquarters economy. We shall implement the Relevant Provisions of Beijing Municipality on Promoting the High-quality Development of Headquarters Enterprises and related supporting measures. Foreign investors are encouraged to set up regional headquarters of multinational companies and various functional institutions in the city to support their business, expand functions, and upgrade to Asia-Pacific headquarters and global headquarters. Qualified regional headquarters of multinational companies shall enjoy facilitation measures such as financial incentives, entry and exit of key personnel, and customs clearance of goods. With innovative measures, we shall continue to do a good job in the introduction and service of regional headquarters and various functional institutions of multinational companies. 5. Encourage foreign capital to establish R&D centers. We shall study and formulate relevant incentive policies and measures for the establishment of foreign-funded R&D centers in Beijing to enhance the global resources allocation and scientific and technological innovation policy source function. Foreign investors are welcome to set up R&D innovation centers, R&D headquarters, innovation platforms, and foreign-funded R&D institutions are encouraged to participate in the city's public service platform construction and government science and technology plan projects. Eligible foreign-funded R&D centers enjoy the same treatment as domestic-funded institutions, and enjoy a series of facilitation measures in terms of industrialization of R&D achievements, international and domestic patent applications, import of R&D supplies, and entry and exit. We shall implement the national tax reduction and exemption policies on technological innovation, and implement preferential policies such as the pre-tax deduction of research and development expenses and tax reduction and exemption for imported equipment for qualified foreign-invested enterprises. 6. Enhance the demonstration and leading effect of the open platform. We shall carry out the legislation of "Two Zones," in-depth reform and innovation of investment and trade liberalization and facilitation, and enhance the accumulation of foreign capital in the pilot free trade zone. We shall make good use of the new round of supporting policies for national economic and technological development zones, optimize the allocation of production factors, focus on international advanced enterprises, and encourage and guide the development of leading industries such as a new generation of information technology, new energy vehicles, biotechnology and health, robotics and intelligent manufacturing in the Beijing Economic-Technological Development Area. We shall give full play to the advantages of international and domestic innovation, build a market-oriented and specialized industrial service platform, create an international collaborative innovation network, and promote the integration and innovation of the "three cities and one district" in key areas such as integrated circuits, new materials, medicine and health, and promote the innovation chains, promote the "three-chain interaction" of innovation chain, industrial chain and supply chain, and guide the development of high, precision and advanced industrial clusters. We shall give full play to the policy advantages of the comprehensive bonded area, actively expand the functions of bonded R&D, leasing and maintenance, and focus on the development of advanced manufacturing, supply chain management, and bonded services. We shall promote the construction of China-Japan and China-Germany international cooperation industrial parks, dock with regional comprehensive economic partnership agreements and other economic and trade agreements, reform international cooperation mechanisms, support the parks to establish and improve channels for foreign investment and intelligence, explore the internationalization of the parks. III. Optimize the development environment of foreign-invested enterprises
7. Promote the facilitation of trade investment and financing. We will implement pilot projects for multinational companies' domestic and foreign currency fund pools, and implement prudential management of cross-border capital flows. We will steadily promote the pilot program for facilitation of foreign exchange receipts and payments in trade, and further expand the scope of pilot banks and pilot companies for facilitation. We shall also optimize and upgrade the facilitation policy of capital project income payment in the city, and promote banks to adopt document consolidation, online processing and other methods. The foreign debt facilitation policy in Zhongguancun Haidian Park shall be upgraded, and enterprises registered in the park that meet the required conditions may enjoy the foreign debt facilitation pilot policy increased from $5 million to $10 million. We shall support eligible enterprises in the 16 parks and 1 zone of the Zhongguancun National Independent Innovation Demonstration Zone to use foreign debt funds for qualified equity investments (except for real estate investment). We shall relax the requirement that the contracted currency, withdrawal currency and repayment currency of corporate foreign debts must be consistent, but the withdrawal currency and repayment currency must be the same. The registration of foreign debt cancellation, domestic guarantee foreign loan cancellation, and overseas loan cancellation registrations shall be delegated to banks. Beijing local banks are encouraged to continuously improve cross-border financial services, and provide facilitation services for high-quality and credible corporate goods trade, service trade cross-border RMB settlement, and domestic use of capital account RMB income in compliance with laws and regulations. The review process of foreign exchange receipts and payments documents will be optimized, and the procedures for the purchase and payment of foreign exchange, receipt and settlement and transfer of foreign exchange under trade in goods and services will be handled in accordance with the principles of business development, facilitating true and compliant cross-border trade foreign exchange receipts and payments. The role of financial support in stabilizing foreign investment will be strengthened, the docking of banks and other financial institutions with foreign-funded enterprises will be strengthened, and investment, loan and financing service mechanisms will be established for key foreign-funded enterprises and projects. 8. Further improve the facilitation of customs clearance. We shall guide and support more foreign-funded enterprises to apply for AEO certification and enjoy more customs clearance convenience, and create an open and transparent customs clearance environment, publish the online and offline air port operation service charge list in unison, update it regularly, so that there are no additional fees charged and the cost of customs clearance can be reduced. We will also accelerate the expansion of the "single window" function from port customs clearance enforcement to the entire chain of logistics and service trade, promote measures such as "declaration in advance" and "two-step declaration" to further reduce the time and improve the efficiency of customs clearance. 9. Make use of preferential tax policies. We shall publicize and implement preferential policies such as no withholding income tax on foreign investors' direct investment by distributing profits. We shall implement the preferential policies for technology transfer enterprise income tax pilot projects in specific areas of the Zhongguancun National Independent Innovation Demonstration Zone (including Chaoyang Park, Haidian Park, Fengtai Park, Shunyi Park, Daxing-Yizhuang Park and Changping Park). Companies that do not exceed 20 million yuan in a tax year are exempt from corporate income tax; those that exceed 20 million yuan are levied on corporate income tax by half. We shall decentralize the approval and management authority of schools for children of foreign personnel, reduce the red tapes and simplify the procedures; relax restrictions on sponsors, and allow domestic social organizations and individuals to run schools for children of foreign personnel. Primary and secondary schools will be encouraged in accepting children of foreign personnel to enroll in accordance with the relevant regulations. 12. Enhance medical security. Beijing has planned to build several international hospitals. It will also support qualified medical institutions to provide international medical services. We shall strengthen the health services of communities where foreign-funded enterprises and employees are located, and provide medical services, explore the establishment of an international pre-hospital emergency service system, and improve the overall level of medical emergency. We shall also strengthen foreign-related service capabilities, support pilot hospitals to employ foreign medical aids and foreign medical guides that meet the working conditions of foreigners in China, strengthen foreign language training for medical staff, and comprehensively improve foreign language services. For high-level foreign talents, innovative entrepreneurs, and high-level talents from Hong Kong and Macao who have obtained permanent residence in China or hold work-type residence permits can apply for residence permit for private affairs of corresponding period for their employed foreign domestic services personnel ("housekeeping services"). A pilot program for facilitation of the personal foreign exchange business of foreign talents in China will be implemented to meet their real and compliant personal foreign exchange needs. The potential of cultural tourism consumption will be released, the cultural resources will be tapped, and enhance the appeal and influence of "Beijing Gifts." 15. Optimize the talent service system. According to the relevant national policies and the demand for overseas professionals in the building of the "Two Zones", a catalogue of professional qualification examinations that foreign personnel can declare will be dynamically launched to attract professionals from the globe to work in Beijing. We shall actively strive for policy breakthroughs and explore pilot projects for mutual recognition of work permits for foreigners from Beijing, Tianjin and Hebei. For the settlement of talents in urgent need of special skills and professionals in this city, the age limit may be appropriately relaxed for those who have outstanding achievements and contributions. We shall provide visa facilities for high-end talents in R&D, practice, exhibition, exchange and training. We shall regularly compile and publish foreign investment guidelines, annual foreign investment reports and other guidelines to provide policy information services and convenience for foreign investors and foreign-invested enterprises. All districts should draw investing Beijing maps based on actual conditions, provide convenient inquiry and site selection functions for foreign investors, and compile and publish guidelines for foreign investment in their respective regions. 21. In-depth implementation of foreign investment laws and regulations. We shall strengthen the publicity and interpretation of the Foreign Investment Law and its supporting regulations and policies, and implement the foreign investment information reporting system. To formulate administrative normative documents involving foreign investment, the opinions of foreign-invested enterprises and relevant chambers of commerce and industry associations shall be solicited in advance, and legality reviews shall be conducted in accordance with regulations. The district governments shall strictly honor the policy commitments made to investors and foreign-invested enterprises in accordance with the law, and perform various contracts signed in accordance with the law in activities such as investment promotion. We shall improve the intellectual property protection system of the exhibition, organize and implement the intellectual property registration system of exhibited products and the non-infringement commitment system of exhibitors. All districts and relevant departments shall not limit the supplier's ownership form, organizational form, equity structure or investor country, and product or service brand in terms of government procurement information release, supplier condition determination, bid evaluation standards. We shall regulate the exercise of the discretionary power of administrative penalties, and strictly follow the harmfulness of the illegal acts and the specific circumstances to implement file-based and step-by-step judgments to avoid unusually severe penalties.
